Terms of service

Last updated 16 September 2026

These terms cover the hosted service at app.echo-mem.com and api.echo-mem.com. The self hosted software is separate and is licensed under the Business Source License 2.0; nothing here adds conditions to it.

The service

Echo Memory hosted is a managed memory graph. You create an account, create API keys, and point MCP compatible agents at the endpoint. We run the database and keep the service available.

Plans and what a unit is

A unit is one fact written or one fact returned. The Cloud plan costs $149 per month and allows 1,500,000 units per calendar month. Enterprise terms are agreed in writing. There is no free hosted plan: running the open source edition yourself is free, and these terms do not cover it.

When the allowance is exhausted, writes are refused until the month rolls over. Reads continue and nothing already stored is deleted. We do not bill for overage automatically, and we will not move you to a higher plan without you asking.

Billing

  • Paid plans are billed monthly in advance through Razorpay.
  • Prices are in US dollars, or the local equivalent Razorpay settles in. Taxes, where they apply, are added at checkout.
  • Cancel at any time from the dashboard. The plan runs to the end of the period already paid for and does not renew.
  • We do not pro-rate refunds for a partial month. If the service failed and you tell us, we will make it right. Write to us rather than argue with a policy.
  • If a price changes, existing subscribers are emailed at least 30 days before it applies to them.

Your content

What your agents write stays yours. You grant us only what is needed to run the service: to store it, index it, and hand it back to you. We claim no other rights over it, and we do not use it to train anything.

You are responsible for what your agents write. Do not use the service to store data you are not entitled to hold, and be aware that redaction before write is an Enterprise feature. On the Cloud plan a secret written into a fact is stored as written.

Acceptable use

Do not use the service to break the law, to store or distribute material that is illegal where you or we operate, or to attack the service or anyone else through it. Do not attempt to reach another account's data. We may suspend an account that does these things, and will say why.

Availability, stated honestly

The service runs on a single server. There is no uptime SLA on the Cloud plan, and it would be dishonest to print one: planned maintenance, and unplanned failure, will both cause downtime. An SLA is available under Enterprise terms, where it can be backed by an architecture that justifies it.

Back up anything you cannot afford to lose. We take daily backups and we have never lost data, which is not the same as a guarantee.

Termination

You may close your account at any time. We may close it for non payment or for the use above, with notice and with an export of your data, except where notice would itself be unlawful.

If we discontinue the hosted service, we will give at least 90 days' notice and an export in the schema the open source edition reads, so that continuing to run it yourself is a restore rather than a rewrite.

Liability

The service is provided as it is. To the extent the law allows, our total liability for any claim is limited to what you paid us in the twelve months before it arose, and we are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.

Changes

We will email account holders before a change to these terms takes effect. Continuing to use the service afterwards accepts the new version.
